Hill sustained a closed-head injury and fractures of the pelvis, wrist, and hand and later developed drop foot syndrome. He incurred $376,000 in past medical costs. Hill had been earning $50,000 annually as a foreman but is now completely disabled. He claimed $1 million in future anticipated wage loss.
Hill claimed the van driver's employer was vicariously liable for its employee's failure to yield the right-of-way.
Before suit was filed, the parties entered into a structured settlement with a present value of $5.75 million, to be paid by defendant's insurer. The settlement consists of a $3 million cash payment with the remainder going into the structured settlement, which has a guaranteed payout of $5.3 million.
