Zimmerman v. JPT Automotive, Inc.

Zimmerman, 72, parked his car on the right side of a one-way street.  As he exited his car, he was struck by a hit-and-run driver who was traveling at about 60 m.p.h.  Zimmerman sustained fractures to both lower legs, one of which required an above-the-knee amputation.  He also suffered extreme pain following the incident until his death of unrelated causes more than five years later.

 

Before his death, Zimmerman sued the driver, who was apprehended following the collision and later pleaded guilty to reckless driving.  Plaintiff alleged the driver was negligent in that he was speeding and failed to maintain control of the car.  Plaintiff also sued the car's purchaser and the dealership that sold the car several weeks earlier.  Plaintiff alleged the dealership failed to register the title with the department of motor vehicles within five weeks of purchase as required by state law and thus had not relinquished ownership and was vicariously liable for the driver's actions.

 

The car dealership contended that it filed with the department of motor vehicles, but the title was returned for incomplete information.  The court directed a verdict on liability, and the trial proceeded on the issue of damages.

 

The jury awarded plaintiff $6.35 million for pain and suffering, and the court added $120,000 for stipulated past medical expenses.  The car dealership's insurer paying $2 million, and the driver's insurer paying the remainder.
