Central Kentucky Product Recalls: Avoiding Injury & Understanding Product Liability Law

Recent product recalls pose the threat of lead poisoning and strangulation hazards to children, leaving central Kentucky kids (and children nationwide) at-risk of serious or even fatal injuries. According to the Associated Press, two of the recent product recalls in the U.S. are All-Star Basketball Chair & Ottoman sets and boys' hooded jackets. The chair & ottoman sets have been recalled because the surface paints of the lettering on the chairs may contain "excessive levels of lead," violating the federal lead paint standard. Although no injuries or accidents had been reported at press time, the HomeGoods stores product has been identified as a threat to children (or anyone who comes into contact with the chair). The boys' hooded jackets, according to the AP, have a drawstring on the hood that could strangle children if not handled properly. Again, no incidents have currently been reported, but the recall exists to prevent such injuries. For more information about these recalls, visit the CPSC website.

These product recalls bring to mind questions from clients about central Kentucky product liability and Lexington defective product law. Many central Kentucky residents want to know if their injuries constitute a legal claim against the manufacturer of the defective or hazardous product. While it is important to ask this question, it is difficult to answer it without knowing the details of the case. Every case is different and must be examined carefully to determine whether the manufacturer may be held liable for injuries. The common factor in each case, however, must be a causal relationship between the maufacturer's negligence and the victim's injuries, which must be proven.
