Product Liability Example: Pottery Barn Recalls Drop-Side Cribs | Lexington Child Injury Lawyer

Pottery Barn Kids recalled 82,000 cribs this month due to the threat of suffocation in the event of the crib’s drop side detaching, according to the Reuters website. The U.S. Consumer Product Safety Commission (CPSC) proposed a ban on the drop-side cribs and similar products because the cribs had been responsible for 32 incidents of strangulation or suffocation over the past ten years. The problem arises when hardware breaks on the crib, which can cause the drop side to detach, creating a space in which a baby can become entrapped. According to the CPSC, there have been 36 reports of drop sides detaching or malfunctioning on cribs sold at Pottery Barn. Seven children suffered minor injuries as a result of the incidents.

The CPSC’s proposal, specifically, is to ban the sale of all drop-side cribs in the U.S. and require them to be removed from day cares, hotels, and other locations. According to Scott Wolfson, the director of public affairs for CPSC, the manufacturing of drop-side cribs is on the decline, so the ban would have more of an impact on the “retail side” of the cribs.

When defective cribs, other children’s products, or other items for children or adults cause injuries, product liability claims may be possible so the injured can receive financial compensation for related medical bills, other expenses, pain and suffering, or time away from work.
